GENERAL TERMS AND CONDITIONS OF SALE SHOP.FISE.FR
It is hereby specified that the present conditions govern the sale of sports equipment and related products by SHOP.FISE.FR. These conditions apply to the exclusion of all other conditions, in particular those in force for in-store sales.
By browsing SHOP.FISE.FR or ordering one of the products offered on this site, the Customer agrees to be bound by these conditions, which apply to all offers, orders and agreements between the Customer and the company, as well as to all operations necessary for their execution.
These conditions are accessible to all on the SHOP.FISE.FR merchant website. The Company reserves the right to modify the present general conditions at any time, subject to displaying these modifications on its Internet site.
Article 1 - Prices
1.1 The prices of our products are indicated in euros, all taxes included (VAT). The mode of transport and its cost vary according to the weight of the order and the distance of the destination country. The shipping costs applicable to the Customer's order are communicated during the ordering process.
1.2 In the event of an order from a country other than metropolitan France, you are the importer of the product(s) concerned. For all products shipped outside the EU and French overseas departments and territories, the price will automatically be calculated exclusive of tax on the invoice. Customs duties or other local taxes, import duties or state taxes may be payable. SHOP.FISE.FR is not responsible for these duties and taxes, which are your sole responsibility, both in terms of declarations and payments to the relevant authorities and organizations in your country. We advise you to check with your local authorities.
1.3 All orders, whatever their origin, are payable in Euros.
1.4 SHOP.FISE.FR reserves the right to modify its prices at any time, but products will be invoiced on the basis of the rates in force at the time orders are registered, subject to availability.
1.5 Products remain the property of SHOP.FISE.FR until full payment has been received.
Article 2 - Orders
2.1 Orders are placed directly on the SHOP.FISE.FR site.
2.2 Any order implies acceptance of the prices and descriptions of the products.
2.3 Orders must be confirmed by SHOP.FISE.FR.
2.4 SHOP.FISE.FR reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order. Furthermore, the Company reserves the right to refuse orders and consequently deliveries to certain countries outside the European Community, without having to justify its decision.
Article 3 - Acceptance
You declare that you have read and accepted these Terms and Conditions of Sale before placing your order. Validation of your order therefore implies acceptance of these General Sales Conditions.
In the absence of proof to the contrary, the data recorded by SHOP.FISE.FR constitutes proof of all transactions between SHOP.FISE.FR and its customers.
Article 4 - Availability
4.1 Our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks. In the event that a product is temporarily unavailable after you have placed your order, we will inform you by e-mail or post as soon as possible.
4.2 In the event of prolonged unavailability (more than 2 months), your order will be automatically cancelled.
4.3 In the event of prolonged unavailability of all or part of the order, reimbursement will be made, at SHOP.FISE.FR's discretion, by crediting the customer's bank account or by cheque within thirty days of payment of the sums paid by the customer.
Article 5 - Delivery
5.1 Products are delivered to the delivery address you have indicated during the ordering process. The times indicated are usual average times and correspond to processing and delivery times. SHOP.FISE.FR cannot be held responsible for the consequences of late delivery.
5.2 In the event of items being delivered on different dates due to their availability, the delivery period is based on the longest period. However, SHOP.FISE.FR reserves the right to split deliveries. In this case, an e-mail will be sent to you.
5.3 In the event of payment by cheque, the order will be processed on receipt of the cheque. Consequently, the delivery times applicable in this case are those on the day of receipt of the cheque and may therefore be modified in relation to those mentioned on the day the order was placed.
Article 6 - Payment
Payment for your purchases is made :
By credit card: - Visa, MasterCard
Or by bank transfer to our account. Bank details are communicated at the time of ordering. In the event of payment by bank transfer, the order will be processed on receipt of the transfer to our account.
Or by cheque: in the case of payment by cheque, the cheque will be cashed on receipt. The cheque should be made payable to ASSOCIATION FISE and sent to the address given at the end of these terms and conditions.
- If possible, and to facilitate the processing of your order, we advise you to print out your order confirmation e-mail and enclose it with your cheque. If you are unable to print your order confirmation e-mail, please note your order number on the back of the cheque. Failure to do so may result in longer processing times.
- Cheques must be issued by a bank domiciled in mainland France or Monaco and made payable to : FFISE APPAREL, 3 rue Christian André-Benoit, 34670 BAILLARGUES. Only cheques in euros are accepted.
- A cheque issued by a natural person other than the one identified at the time of ordering will only be accepted if accompanied by a written and signed agreement from the person issuing the cheque, together with a photocopy of his or her identity document and telephone number.
- In the event of payment by cheque, delivery times will be extended. Your order will be processed as soon as we receive your cheque.
Article 7 : Security
The SHOP.FISE.FR store is subject to a security system: we have adopted the SSL encryption process and we have also strengthened all the scrambling and encryption processes to protect all sensitive data linked to means of payment as effectively as possible.
Article 8 - Product conformity
8.1 If, upon delivery, the product :
8.1.1 Does not correspond to the order,
8.1.2 Has defects
8.1.3 Is damaged,
The Customer may request a refund or exchange within 7 working days from the day after delivery, provided that the product is in its original packaging.
8.2 The product and the request for exchange or refund must be sent, at the Customer's expense, together with a photocopy of the purchase invoice to the address given at the end of these general sales conditions.
No cash-on-delivery shipment will be accepted, whatever the reason. Return shipping costs will be reimbursed upon request and upon proof of purchase, which you must enclose with your request for exchange or reimbursement.
8.3 Products opened, damaged or soiled by the customer will not be refunded or exchanged.
8.5 In the event of improper returns, the Company reserves the right to refuse any further orders.
Article 9 - Refunds
9.1 Refunds for products in the cases referred to in Article 8 will be made within 30 days or less of receipt of the products by us.
9.2 Refunds will be made, at SHOP.FISE.FR's discretion, by crediting your bank account or by cheque sent in the name of the customer who placed the order and to the billing address. No cash-on-delivery shipment will be accepted for any reason whatsoever.
Article 10 - Right of withdrawal
10.1 The Customer has the right to notify the Company that he/she renounces his/her purchase without penalty and without giving reasons within a maximum period of 10 working days from the day following the day of delivery. You will then be responsible for shipping and return costs. Only the price of the product(s) purchased will be refunded.
10.2 Products must then be returned at the customer's expense in their original packaging, unopened and undamaged by the customer within 10 working days from the day following the day of delivery, to the address given at the end of these general terms and conditions of sale.
10.2 Refunds will be made, at SHOP.FISE.FR's discretion, by crediting your bank account or by cheque sent in the name of the customer who placed the order and to the billing address. No cash-on-delivery shipment will be accepted for any reason whatsoever.
10.3 Refunds of products in the cases referred to in Article 10 will be made within 30 days of receipt of the returned products by us.

Article 12 - Liability
12.1 The products offered comply with current French legislation. SHOP.FISE.FR cannot be held responsible in the event of non-compliance with the legislation of the country where the products are delivered. It is your responsibility to check with local authorities about the possibility of importing or using the products you intend to order.
12.2 Photos are provided for illustrative purposes only. Please refer to the description of each product for its precise characteristics. In case of doubt or if you require further information, please do not hesitate to contact our customer service department (CF. Article 11).
12.3 In the event of a manifest error between the characteristics of the product and its representation and/or the conditions of sale, SHOP.FISE.FR shall not be held liable.
12.4 In the event of hypertext links pointing to other sites from SHOP.FISE.FR, SHOP.FISE.FR shall not be held responsible for the content of information provided on these sites after activation of these links.
12.5 In the case of professional purchases, SHOP.FISE.FR shall not be held liable for any indirect damage including operating loss, loss of profit, loss of opportunity, damage or expenses.
Article 13 - Applicable law - Disputes
The present contract is subject to French law. The language of this contract is French. In the event of a dispute, the French courts shall have exclusive jurisdiction.
Article 14 - Personal information
14.1 SHOP.FISE.FR undertakes not to divulge to third parties the information you provide. This information is confidential. It will only be used to process your order and to reinforce and personalize the communication and product offer reserved for SHOP.FISE.FR customers, in particular by the SHOP.FISE.FR site newsletters to which you have subscribed, as well as in the context of personalizing the site according to your centers of interest.
14.2 However, when you visit SHOP.FISE.FR from certain partner sites of SHOP.FISE.FR and identified as such, or if you go from SHOP.FISE.FR to partner sites of SHOP.FISE.FR and identified as such, data concerning you may exceptionally be communicated to them. To find out what information they may have stored about you, please contact the partner site from which you came or to which you are going.
14.3 In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to any personal data concerning you. 14.4 Our site is also designed to be particularly attentive to the needs of our customers. This is one of the reasons why we use cookies. The purpose of a cookie is to indicate that you have visited our site. Cookies are therefore only used by SHOP.FISE.FR to improve our personalized service to you.
